Door een bestelling te plaatsen via SongFactory.eu ga je akkoord met de onderstaande algemene voorwaarden. Lees deze aandachtig door.

1. AI-generated content

Lyrics, music and any additional content are generated entirely or partially using artificial intelligence (AI), based on the information you provide. Songfactory provides a best-effort obligation, not a result obligation.

2. Personal and creative nature

Every song is subjective and creative in nature. Differences in style, tone, voice and interpretation are inherent to the process and do not constitute a valid reason for rejection, cancellation or refund.

3. Usage rights (licence)

Upon delivery you receive a personal, non-exclusive and non-transferable licence for private purposes. Commercial use is not permitted without written consent.

4. Commercial use

If you wish to use the song commercially, you must contact us in advance for an additional licence agreement.

5. Provided information

You are fully responsible for the content, accuracy and lawfulness of the information provided.

6. Quality control

Songfactory carries out a personal quality check within 48 hours of delivery for every order. If the delivered song does not meet our quality standards, you will receive two handcrafted alternatives including lyrics free of charge. This quality guarantee applies solely on the basis of objective quality criteria and not on the basis of personal taste or preference.

7. Quality guarantee

If Songfactory determines after quality control that the delivered product does not meet reasonable quality standards in terms of pronunciation, musical quality or technical execution, Songfactory will proactively contact the customer and deliver two new songs including lyrics free of charge. The customer does not need to take any action for this.

8. Delivery and delivery time

Delivery times are indicative. Delays do not give the right to cancellation, compensation or refund.

9. Cancellation and refund

After the creative process has started, cancellation is no longer possible. After delivery, refunds are excluded.

10. No professional advice

The generated content is intended exclusively for entertainment and creative purposes.

11. Liability

Songfactory is not liable for direct or indirect damages. Total liability is limited to the amount paid.

12. Technical delivery

Songfactory is not responsible for compatibility, download issues or external services.

13. Use for promotion

Songfactory may use anonymised parts for portfolio and marketing purposes, unless the customer objects in advance.

14. Force majeure

Songfactory is not liable for failures in AI systems, technical problems or outages from external suppliers.

15. Misuse

In cases of misuse or fraud, Songfactory reserves the right to cancel orders without refund.

16. Amendments

Songfactory reserves the right to amend these terms at any time. The most current version is always available at songfactory.eu/algemene-voorwaarden.

17. Storage of photos

Photos uploaded during the ordering process are automatically deleted from our servers 14 days after delivery. Songfactory is not liable for the loss of these files after this period has expired.

18. Spotify package — revisions

The customer is entitled to a maximum of 3 revisions of the song before publication on Spotify. After 3 revisions, the customer chooses which version is published on Spotify, or waives publication. In both cases, no refund will be issued.

19. Spotify package — approval

After delivery of the song, the customer receives an approval link. The song is only submitted for publication on Spotify & Apple Music after the customer has approved it via the approval link. As long as no approval has been given, no publication will take place.

20. Spotify publication

The song is released under Songfactory's artist page on Spotify and Apple Music, not under the customer's name. The customer does not acquire any ownership of, or claim to, the artist page.
